Why Mediation is the Best Divorce Process

Everyone has heard of or seen the most difficult way to get a divorce, which is through contested courtroom litigation. In that scenario, both sides are represented by their own attorney who will present evidence to the court in an effort to outmaneuver the other party. These types of divorces can be very adversarial, emotionally depleting, and can seriously impact one's finances. They can also be lengthy, dependent on court schedules, very public, and the results can be unsatisfactory for both parties who must comply with whatever the judge decides. Couples who go through a heavily contested divorce in litigation give up ultimate control over the divorce settlement because they are subject to a court ruling.
Divorce mediation is a much less contentious way to handle a divorce. It is done through private sessions where a third party mediator helps the divorcing couple work through their differences to achieve a mutually-acceptable divorce agreement. This agreement can then be submitted to the court for approval. In this scenario, however, the two parties must be willing to peacefully negotiate with one another on all of the issues at hand. These issues include such matters as child custody and visitation, spousal support, and the division of marital property and debts. The negotiating sessions are private, held at the convenience of the parties involved, with each party having the full and complete freedom to make decisions and veto any provision they find unacceptable. With the professional advice of their own attorney, each party can make informed choices that will generally prove to be more satisfactory than court orders handed down in contested cases.
