The state of California has various types of protective orders, also known as restraining orders, which the courts can provide to protect individuals and / or their children from abuse and harassment. These include emergency protective orders, domestic violence restraining orders, civil harassment restraining orders, elder and dependent adult abuse restraining orders, and more. It is not uncommon in many situations of abuse or threat of violence to have more than one type of protective order in place.
An emergency protective order is an order which protects someone from abuse, harassment, or stalking and can be obtained 24 hours a day from the police. A domestic violence restraining order prohibits the named person from making any type of contact with the protected person and any children involved. It protects individuals from family members, spouses, ex-spouses, parties who have a child together, or those who are involved in a current or past intimate or dating relationship. This type of restraining order and the following types are obtained from the court. A civil harassment restraining order protects individuals from others not mentioned in a domestic violence restraining order. An elder and dependent adult abuse restraining order protects the elderly population and dependent adults from abuse, whether physical, financial, neglect, isolation, abduction, harm, or deprivation by a caregiver. Certain types of evidence are needed to present to the court to obtain protective and restraining orders.
