Grandparents' rights in family law revolve around the issues of visitation rights and even custody for petitioning grandparents. The laws concerning this area are complicated and, if you are seeking your rights to access a grandchild, you will be best served by seeking the legal counsel of an experienced family lawyer in your area.
In Nevada, grandparents' rights are covered under the Nevada Revised Statutes 125C.050, entitled "Petition for right of visitation for certain relatives and other persons." Under this law, not only grandparents but other interested parties as well can petition the courts for visitation rights. The law lays out in what circumstances the court may grant reasonable rights to visitation of a minor child. These circumstances include:
- The child of a parent who is deceased
- The child of a parent who is divorced or separated from the custodial parent
- The child of an unmarried parent who is now deceased or separated from the other parent
- The child of a parent who has relinquished his or her parental rights
- The child of a parent whose parental rights have been terminated
Those who may seek visitation rights to these children include great-grandparents, grandparents, and the other children of either parent. A person, whether related or not to the child, who has established a meaningful relationship with the child may also be granted visitation rights by a family court.
