Men in Domestic Violence Cases Released on Technicality

Three men who would normally have been held longer for trial were released this week in Shawnee County over a technicality.
While the district court judge who released them did say that the men could later be tried, it appears as though there was an argument as to who would prosecute them. All three were charged with misdemeanor domestic violence, a charge that could be prosecuted either by the city or the district attorney. This decision by the court came after the district attorney's office stated that it would no longer handle misdemeanor cases, including domestic violence. A reduction in state funding led to the decision of the district attorney to stop prosecuting such cases.
