Recently, a Supreme Court in the state of North Dakota has thrown out the appeal of a woman who took her children into the state of South Dakota after she was ordered by the courts to give up
child custody.
Reports indicate that the woman, Lisa Colombe, had requested that the high court reverse a previously issued order that granted custody of her 5 year old daughter and 2 year old son to the children's father, Jessy Carlson.
After Colombe refused to allow Carlson visit their children, she was found in contempt of court. Additionally, she did not show up for a trial in Bismarck that was to decide upon the terms of child custody. She later appealed the ruling the court made after he failure to appear. Officials claim that she took the children to South Dakota to Rosebud Sioux Reservation after she was ordered to give up custody.
Last week, the North Dakota Supreme Court unanimously ruled that Colombe's appeal should be dismissed. They said that Colombe is considered a fugitive and that she cannot ask for a reverse in a court order against her due to the "fugitive dismissal rule".
