Modifications of California Child Custody Orders

Child custody orders may require changes in the years following their initiation. The court has ongoing authority to modify custody orders at any time based on what it perceives to be in the best interests of the child(ren). These changes or modifications may be sought by one or both of the parents involved. In order to modify an existing child custody order, a parent must have a plausible reason which will need to be presented to the court as evidence.
Reasons for requesting a modification to child custody include a significant change in a parent's or the child's circumstances, such as a major change in a parent's income, a parent's remarriage which might involve a relocation to another geographical area and additional children to which the parent is financially obligated. The custodial parent also may wish to relocate due to a better job offer which could enhance the child's life. Other changes which could affect the child custody issue include a parent contracting a serious illness, the death of a parent, the current custody arrangement posing a physical or emotional threat to the child's welfare or safety (such as domestic violence or parental or household substance abuse), one parent refusing visitation rights to the other, the child reaching an age where he or she would prefer a change in custody, or the child experiencing new or additional needs in terms of health or education.
