Parenting Plans in Florida Divorce Cases

In 2009, the Florida legislature turned "child custody" into "timesharing." This legal concept was designed to make the process of determining issues concerning children less adversarial between divorcing parents. As part of any timesharing arrangement, parents in Florida are required to submit a Parenting Plan to the court for approval. The Florida Supreme Court Approved Family Law Form which details a parenting plan states that as a minimum, such a plan should describe in detail:
- How the parents will share and be responsible for the daily tasks associated with the upbringing of their children,
- The time-sharing schedule arrangements that will specify the time that the minor child(ren) will spend with each parent,
- A designation of who will be responsible for any and all forms of health care, school-related matters, including the address to be used for school-boundary determination and registration, other activities, and,
- The methods and technologies that the parents will use to communicate with the child(ren).
When parents cannot agree between themselves on legal arrangements concerning their child(ren), the court will decide the matter, taking into consideration 20 factors, based on what it considers to be in the best interests of the child(ren).
