Divorcing couples must address a number of legal issues in order to complete their divorce agreement. These are all typically sensitive in nature due to the fact that they involve finances and the family and are legal in nature.
Whether a divorce is approached in an amicable or contested manner, it will be necessary to determine:
Property and Asset Division - no matter the amount of property or assets that a married couple may share, it will be necessary to determine what is classified as marital property versus separate property. Marital property will be subject to distribution between spouses. This may include the family home, other real estate, furniture, electronics, art, bank accounts, retirement funds, investments, motor vehicles and more.
Spousal Support - in some cases, one spouse will be required to pay regular payments to the other spouse in order to help him or her maintain financial stability. Whether spousal support is required in a divorce will depend on the length of the marriage, each spouse's contribution to the marriage, whether one spouse was dependent upon the other, and more.
Child Custody/Visitation - if a married couple has children, they will need to determine how custody will be arranged. The ideal arrangement is often for parents to share custody, but in some situations one parent may be granted sole custody and the other visitation rights.
Child Support - one parent may be required to pay child support to the other parent for the child or children's upbringing, to pay for food, shelter, clothing, medical care, education, etc.
It is important to have an advocate for your rights, needs and financial interests in order to reach positive arrangements regarding all these matters.
