Alternative to Divorce

Are you having marital troubles but do not want to get a divorce? If so, a legal separation might be more appropriate for your situation.

Instead of a separation where you and your spouse may live apart for a period of time, a legal separation is an act recognized by a court of law. It allows you to live separately from your spouse but enjoy many of the legal benefits of marriage. You will go through many of the same procedures as you would for a divorce but it will not end your marriage until you are completely ready.

In a typical legal separation, you will be asked to discuss items such as child support, custody, alimony, visitation rights and division of property. Once you have had your legal separation approved by the court, you will no longer be recognized as a couple. From there on out, you can stay separated, reconcile your marriage or opt for a divorce later on.

Have questions pertaining to separation?  Be sure to speak with a family lawyer near you immediately.
