Florida Supports Family Dispute Resolutions

In the state of Florida, if you have a dispute with another party, there are actions that you can take in order to resolve your differences without ever stepping foot inside a court room. The process of handling a family law related issue or a divorce issue is called an alternative dispute resolution.
An alternative dispute resolution is a process that allows people to resolve their disputes without having to use the court system. Popular methods include mediation (where a neutral third party helps the two parties come to an agreement) and arbitration (where a neutral third party listens to both sides then issues a decision), however there are a number of ways which to address a problem outside of the courtroom.
Alternative dispute resolution has gained widespread acceptance across the nations’ courts and the legal profession. The reason for the rising popularity of ADR has to do with the rising caseload among traditional courts. In addition, ADR is less expensive than a long, drawn out trial and it gives both parties the confidentiality they so desire.
ADR is generally grouped into four categories; negotiation, mediation, collaborative law, and arbitration. The one common factor in traditional ADR is the presence of a third party who offers their unbiased opinion. However, in collaborative divorce, each spouse will have a family law attorney who will facilitate the resolution process and make sure that all agreements abide by contract terms.
