Domestic Violence and Restraining Orders

Domestic violence is no stranger to families and divorce. Domestic violence has plagued families around the world for countless generations, regardless of race, religion or socio-economic class. When it comes to husbands and wives and parents and children, domestic violence or abuse consists of both physical and/or emotional abuse. Family law attorneys frequently encounter divorce situations where domestic violence was a factor in the dissolution of the marriage, whether the domestic violence was directed towards a spouse, the children or both. Domestic violence has prevailed in families since the beginning of time; however, only in the last hundred years has awareness changed the way the law views domestic violence amongst families and in the home.

If you are a victim of domestic violence, there are legal actions that you can take in order to protect yourself and your children. A Jacksonville family law attorney can help you file a Restraining Order against your abusive spouse. In Florida, there are 4 types of Restraining Orders, and they are: Emergency Protective Order (EPO), Domestic Violence Temporary Restraining Order (DVRO or TRO) and a Criminal Protective Order or “No Contact Order.”

Emergency Protective Order – This restraining order is an “emergency order” which is issued by law enforcement for a period of 5 days. This is used by victims of domestic violence.

Domestic Violence Temporary Restraining Order (TRO or DVRO) – A civil restraining order which is temporary for 3 consecutive weeks; however it can be made permanent for 1 to 3 years.

Criminal Protective Order “No Contact Order” – Issued in active domestic violence cases, this order is issued by the District Attorney’s office.
