The details and basic agreements laid out in a divorce and approved by the courts sometimes have to be modified if circumstances change in the lives of either spouse and the agreement becomes too difficult or impossible to maintain. The definition of the word modification itself lends an understanding as to what it is in relation to a divorce or separation agreement.
Unexpected things do happen in life and it is possible to change or modify divorce or legal separation agreements to weather those changes. This process should be done with the help of a family law attorney.
Reasons for Modification
There can be numerous reasons for modifying a divorce agreement; some of the more common ones are as follows:
- A change in income level (either less income is being made and spousal or child support payments will have to be revised to accommodate the change and lessen the payments or an increase in income has occurred which necessitates an increase in payments)
- A partner moves to a different location which affects the agreement
- The needs of a child change dramatically (illness, injury, hospitalization)
- A partner winds up being incarcerated which could affect child custody agreements previously drawn up
- A situation involving neglect or abuse may occur whereby you need to change custody or visitation agreements
