What Is A 730 Evaluation?

Getting a divorce is never easy, especially when children are involved. While most cases can be resolved through mediation or open discussion, there are times when child custody cases require a 730 evaluation. This evaluation is reserved primarily for those cases where there is high conflict or a question of mental illness. It is ordered by the court and usually requested by one of the feuding parties. Under family code a 730 evaluation will be conducted by a trained professional. This person will take testimony not only from the parents but from any minor children involved in the divorce as well.

It is not a short process, however, as most evaluations can take anywhere from 3 to 5 months to complete. Once the evaluator is finished with the investigation, a report will be written and presented to the court. This information will help the judge determine the best scenario of child custody that will protect the children named in the evaluation. If you are going through a challenging child custody matter and would like professional legal help take the time to speak with a family lawyer in your area.
