Florida Addressing Outdated Alimony Legislation

States across the nation are in the process of changing old and outdated alimony laws. Florida currently has two bills under consideration that could seriously affect how alimony is awarded in the state. While both bills address different aspects of alimony, their general tone is the same. Both bills are intended to protect the person paying out alimony and limit the abilities of the person receiving alimony. These changes come after the public outcry of those that have experienced financial ruin due to outdated alimony laws.

One of the changes that could come about would be how adultery affects alimony. Under the old laws, judges could look at the level of infidelity present in a marriage to help determine the amount of alimony paid. If passed, the new law states that this would only come into effect if the adulterous situation affected the marital income of either party. Thus, adultery would be considered less than other items when it comes to the total award granted to the recipient party. Do you have questions related to alimony payments in the state of Florida?
