Court to Decide Whether Prenup Should be Overturned

Although most prenuptial agreements cannot be revoked, there are times when the court will consider overturning an agreement. One case between a multi-millionaire and his second ex-wife is going before a state Supreme Court this month. The millionaire signed a prenuptial agreement in which he agreed to pay his ex-wife, a professional stripper, a certain amount of money. When they divorced, he fought the prenuptial agreement in court but lost at the family court level. His attorneys have since appealed the decision which brought the case to the state Supreme Court.

Several more cases have reached the Supreme Court level over the past year regarding similar prenuptial agreement disputes. In another case, a billionaire asked the children of his future wife to sign prenuptial agreements as well, a request that was denied by all. He is using this claim to have the agreement revoked by the higher court. Requests from various parties have been sent to lawmakers to have the antiquated laws changed to no avail.
