Lawsuit May Change the Way Child Support is Processed

A lawsuit in Georgia could change the way that late child support payments are processed. Parents that have been unable to make child support payments are being asked to join the lawsuit en masse.

So far five parents are part of the class-action lawsuit. It was approved by a judge late last year as a class-action lawsuit, which means that more people can join before it is formally filed. These individuals were jailed as a result of failing to make child support payments. Their primary argument is that they were unable to afford an attorney to represent them.

These individuals are fighting for the rights of others like them, those that are unable to afford an attorney to avoid being jailed. They claim that anyone with late child support charges should be granted court-appointed representation. In most cases, these people were unable to make their payments due to loss of work or health problems.
