Domestic Violence Can Impact Family Law Matters

When two parents have shared parental responsibility, this means that a judge has determined that both individuals will have an equal say in the life of their child. However, if one of these people turns out to have a history of domestic violence in the family, the rules of parental responsibility can change significantly.
In most cases, parents that share responsibility after divorce are both responsible for the well-being of the child. This includes but is not limited to the topics of education, religion, primary residence, dental and medical care.
Yet, if one parent presents the issue of domestic violence in the court room, the judge will have to take this into consideration. No matter what both parents want in regards to their child, the judge will always take what is in the best interests of the child into consideration first. Should domestic violence be proven by one parent, it is likely that he/she will not be given shared parental responsibilities.
