While you may want to keep your children at home with you, a judge will always determine what is best for the child, even if it goes against the wishes of the parents. In most cases, one parent will be awarded sole custody. This is when the child lives with that parent full-time and the non-custodial parent is given visitation rights.
However, if both parents are able to support the child living with them and have the time to care for the child, both can petition for joint custody. This allows both parents to make decisions regarding the child, such as medical, religious and educational. When sole custody is granted, the parent that has custody of the child has the legal right to make most of the decisions for the child without the consent of the other parent.
