Child Custody and Moving Out of the State

Obtaining a change to your existing child custody agreement is not impossible, but it can be difficult.

There are times when one parent may want to move out of state with the child. If this parent is the primary caretaker, that person has the right to move. However, the move must be first approved by the court. If the second parent does not want the move to happen, however, the first parent must complete a "move away" request.

Before you attempt to bring your case to court, whether for or against the move, it is important to speak with a family law attorney. While you may have good reason to move away with your child, or a good reason to request that your child stay in the state, the judge will ultimately go with what is best for the child. Therefore, you will need to craft an argument that shows why your request should be honored over that of your former spouse/partner.
