The Benefits of Collaborative Divorce

Although most people associate divorce with nasty battles over property and children, not all marriages have to end that way. There are positive ways to finalize your divorce instead of having two people battle against one another.

A new type of legal discipline, referred to as collaborative law, allows the two parties to work peacefully together to resolve the final arrangements of their divorce. This happens with both spouses agree to sit down with the attorneys and negotiate an outcome that is appealing to both sides. However, if an agreement cannot be reached, the parties must abandon their lawyers and stronger actions must be taken.

In many cases additional experts are brought in to make the process easier. In order to help both sides, financial specialists and mental health experts may be asked to come and aid in the process. When both sides have agreed to the final product, a Marital Settlement Agreement is signed and brought to court.
