Facebook Impacts Child Custody Cases

Be careful what you post on your Facebook page as it could be used against you in a court of law. A recent case in Park Cities, TX, granted full custody to a father after his suspicions about the illicit activities of his ex-wife and her current boyfriend were affirmed by the social media outlet. Although the father had had suspicions that the mother of his 5 year old son was up to no good, he had no way to prove it until his attorney, Michael Wysocki, obtained photos of the woman and her husband engaging in activities that were not befitting a qualified parental figure.

Wysocki unearthed months of photos that included the mother and another woman engaging in lascivious behavior and of the boyfriend brandishing a semi-automatic rifle while smoking which convinced the judge to ask the woman for a drug test. When she failed that test, the judge granted the Park Cities man full custody of his son.

About 20 percent of cases that involve child custody issues now involve some sort of social media as part of the testimony, according to some legal experts.
