In New York State an order for support can be issued to the non custodial parent on behalf of the child, the custodial parent, the state if the child receives state benefits, or any person who has physical custody of the child. A request for child support can be attained by a parent who was never married to the non custodial parent, but in such cases paternity must be proven.

After a child support order has been issued, whether as part of divorce, separation, or other family law proceedings, the order can be modified. A change in circumstance that could warrant a modification in child support can include:

·         An increase or decrease in your or your spouse's pay

·         A disability

·         Loss of a job

·         A change in visitation schedule

·         Remarriage
