Teen Wins Restraining Order from Parents in Texas

In Texas, a significant family law case has finally come to an end when a Texas teen won a restraining order against her parents who have been pressuring her to abort her baby. The 16-year-old teen became pregnant with her boyfriend’s baby, but her parents told her that she should immediately have the fetus aborted in order to save trouble. Her parents were enraged when she refused to submit to them and decided that she wants to carry and then mother the baby. She also intends to get married to the baby’s father. In retaliation, the parents have allegedly confiscated their daughter’s car keys and cell phone and have forced her to remain home from school. They said that they would restore these privileges when she obeyed their wishes to obtain an abortion.

As a result, the teen took legal action. She told the court that her parents were coercing to have her child aborted, but as a woman she believes that she has the right to choose whether or not her child should live. After deliberation, a Texas court agreed with the teen and her lawyer, and issued a restraining order against the parents involved. The parents will not be banned from seeing their daughter, because she currently lives in their home. Instead, they will be banned from coercing her in any way or in any way motivating her to abort the child. They will need to restore her cell phone, car, and privileges to attend school to her and will not be permitted to threaten her in any way.

According to claims by the teen, her mother has threatened to slip abortion pills into her food and drink at the house. This has caused the teen to avoid eating at her home when possible because she has lost trust for her mother. The teen was represented by an attorney at the Texas Center for the Defense of Life. The attorney who came alongside her offered services free of charge. The center called the case a tremendous victory for them because they believe that they were able to prove that “choice” goes both ways.

A landmark case for abortion was Roe V. Wade, which was when the courts determined that women had the right to choose whether or not to abort their babies without any outside influences. This statute applied to all women who were pregnant, not just those who were adults. This teen may be under her parents’ authority but she is still given the right to choose her baby’s future. While Roe V. Wade is most often cited in cases where the mother is arguing for the right to an abortion, there are also times that it applies to cases where a woman does not want to have an abortion and needs legal protections against those who are motivating her to get one.

As a part of the final verdict on the case, the parents have given this pregnant teen permission to marry her 16-year-old boyfriend and her parents will pay half of the health insurance deductible and half of the unreimbursed medical expenses related to the pregnancy if the teens are not married by the time of the child’s birth. The biological father of the child says that he and his parents also felt threatened by his girlfriend’s mother and father. Allegedly the pregnant teen’s mother verbally pressured her to get an abortion and told her that she had no choice in the matter. While most restraining orders are issued between feuding spouses or patterns, this new case in Texas brings up another issue of teens who are pressured and whose rights are violated by their parents.
