Child custody can be a hot issue in a divorce. If the divorcing spouses cannot agree on a custody arrangement, the matter will go to court where a judge will make a decision based on the evidence presented by each side. In Pennsylvania, the judge will decide the issue of custody based on what is in the best interests of the child with an emphasis on any factors related to the child's safety. Many factors may be considered by the court under Pennsylvania law. These include which parent is the more likely to encourage a frequent and continuing relationship between the child and the other parent, whether evidence shows that a parent has committed any form of abuse, parenting skills, the issue of stability and continuity in the child's life and how custody with a parent will affect that, whether the child has siblings and how that will affect custody, the child's preference in the matter if old enough to have a reasonable opinion, whether a parent has tried to turn the child against the other parent, which parent can best physically, emotionally, and financially care for the child, whether there is a history of drug or alcohol abuse, and many other relevant factors.
If divorcing parents have agreed on child custody, they can present it to the court in a written agreement in the divorce process. Such an agreement will need to be specific regarding custody arrangements, including such details as where the child shall spend weekends, holidays, and vacations. Those who already have a written custody arrangement in place who live separately and apart can obtain a divorce without changing the custody agreement.
